Digna’s coaching, questions and exercises

Digna’s coaching, questions and exercises

By entering the route of a conscious contract one encounters oneself as well as the other party in a totally different way as in normal contract negotiations. Due to Digna’s coaching, questions and exercises I came to understand that a certain cooperation came on the wrong moment – a discovery that never crossed my mind. This wasn’t a pleasant revelation, since mutual expectations were not delivered. But it was an extremely valuable route because it saved us from entering a multi-annual course together, without really checking carefully whether this actually was a good idea.
Digna also coached us towards a respectful closure, whereby everyone could share his disappointment in an honest way, while remaining dignified towards each other.
I am truly thankful for Digna’s work and also as a lawyer and mediator Digna has become a great source of inspiration for me!

Value-based contracts and Face the Future

Value-based contracts and Face the Future

In 2015 Face the Future began to convert their employment contracts.
Managing director Kees Hoogendijk: “We wanted to change the standard contracts into value based contracts, a process we implemented with advice and co-operation from Digna de Bruin.
Defining the values in our organisation and applying them in daily practice has been very beneficial.
Observing these values enables all employees and the management to address each other with respect, transparency and safety.
This started an ongoing process, according to the discussions from the shop floor.
Understanding, experiencing and practicing clear values is enriching employees as well as the organisation”.

Advocacy Digna de Bruin: best of two worlds

“As a construction costs specialist I had the opportunity to work together with Digna, and in a refreshing style. To her substantial experience in traditional law she adds elements which work towards solutions instead of towards conflict. She is thinking less in opposites between parties, and asks with in-depth questions for the underlying motivations of a dispute.
Digna is a pioneer and an example of a person who steps ‘out of the box’. This costs courage and energy.
She demonstrates a different kind of lawyer’s practice and responds to the spirit of the time.
Result is, that both parties solve a case with a satisfactory feeling. And one has learnt from her in a human sphere as well.”

With sharp insight counseling towards agreement

With sharp insight counseling towards agreement

From just another zoning procedure towards an acceptable agreement

“As owner/resident of a third part of a thatched nationally listed 1580’s monumental building, I had a long lasting dispute of fifteen years with the owner of a community building under the same roof. This building was not suitable for simultaneous functions as residing and social meetings, which regularly resulted in noise disturbance late into the night.
Agreements regarding a.o. insulation, measures concerning fire safety and the parking of bicycles on my access road were effectuated with great difficulty, and afterwards not observed.
Subsequently the municipality of the town of Soest, as a result of a new development plan, decided to amplify the use of the community building, which would increase the annoyance even more.
That was the moment that I was certain that well-intentioned talks and negotiations were no longer of any use.
Now legal aid was required and a friend recommended Digna de Bruin. If any person would be capable to achieve a solution for this complex situation, it would be her. And she was; she became my saviour. A warm hearted, compassionate and professional human being, who exactly felt what this was about.
It was extraordinary to see how from that point she subsequently started to work towards a solution. And in such a natural way, discretely and unnoticeably, she guided us towards an agreement which was acceptable for both parties.

Thank you Digna. You’re a trooper!”

An open and constructive approach to get tied up positions moving again

“I got to know Digna as the lawyer of a formidable counterparty of a municipality in a conflict, dragging for decades.
Digna, despite the conflicting interests and the burdensome history, has been able to consult in an open, informal and constructive way with the objective to get tied up positions moving again.
I have come to know Digna as a persistent and in particular as an honest opponent. With her convincing acting in full knowledge of the facts she uses her empathic ability to solve old disputes, crossing bridges and treading new paths.”

Holistic advocacy; something rather vague?

“Perhaps, but in actual fact it is just about common sense and utterly realistic.
Obsolete paradigms (such as ‘survival of the fittest, win/lose, top down, etc.) do not work anymore.
The spirit of the age caught up with these concepts. The present economic crisis is foreboding a new paradigm with a holistic vision.
Those who deny this, do not grasp the present and live in a dream world. That really is vague and fictitious!
In an age in which inanimate structures collapse and inspiration gets structure, the time calls for new advocacy.
For a long time the profession was subject to striving for a maximum winning situation for the client, with minimal consideration for the ‘opposing party’. However, since in this day and age we increasingly realize that at the deepest level we are not separated from each other, but we are one, one family, this approach is now obsolete. Therefore I am pleased that Digna, as a pioneer in this process, rises to the challenge and commits herself to a new approach within the profession.
It is courageous to question old certitudes and ingrained patterns and enter untrodden pathways.”

Not a typical lawyer

“Immediately upon meeting Digna, I knew she was not a typical adversarial lawyer or even a typical person. She was deeply connected and thoughtful, a woman who brought to mind images of deeply rooted trees, providing cool shade in troubled times. Anyone would be lucky to have her as a lawyer, advocate, healer, or friend.”
